APPLICATION FOR TOURISM TRAINING INSTITUTIONS LICENSE GUIDELINES WHO CAN APPLY? - The applicant must be a Private Limited Company incorporated under the Companies Act 1965.
APPLICATION FORM - The application shall be made by submitting one (1) copy of Form 1 (Regulation 3) or two (2) copies, if the form is submitted at the Regional Licence Office.
COMPANY NAME - The name used by the company shall be appropriate and shall reflect a Tourism Training Institution.
PAID-UP CAPITAL - The minimum paid-up capital is RM200,000.00.
WORKING PAPER - Shall be submitted in one (1) copy or in two (2) copies if submission is made to the Regional Licensing Office, and the working paper should contain information as per guidelines that can be obtained from the Licensing Division, Ministry of Tourism, Malaysia or the Regional Licensing Offices.
PROCESSING FEE - A processing fee of RM100.00 shall be submitted with the application.
LICENSING FEE - A licensing fee of RM1,500.00 (for 3 years)
TOTAL PAID-UP CAPITAL SHAREHOLDINGS - Malaysian Citizen
- Bumiputera equity 100%, Non-Bumiputeras or joint-ventures between Bumiputera and non-Bumiputera are allowed an equity of 100%
- Non-Malaysian Citizen
- A company owned by a non-Malaysian citizen will need to restructure its shareholding as follows before it is licensed:
- Bumiputera 30% (minimum)
- Non-Bumiputera 40% (maximum)
- Foreign citizen (company only) 30% (maximum)
DOCUMENTS TO BE ATTACHED WHEN SUBMITTING APPLICATION - Documents and the Companies Act 1965 forms verified by the Registry of Companies
- One (1) copy of the Company's Memorandum and Articles of Association
- One (1) copy of Form 9 - Certificate of Incorporation of Private Company
- One (1) copy of Form 13 - Certificate of Incorporation on Change of Name of Company
- One (1) copy of Form 24 - Return of Allotment of Shares
- One (1) copy of Form 25 - Statement Containing Particulars of Shares Allotted Otherwise than for Cash
- One (1) copy of Form 32A - Transfer of Securities
- One (1) copy of Form 49 - Return Giving Particulars in Register of Directors, Managers and Change of Particulars
- One (1) copy of the bank statement in the name of the company for the last three (3) months
- One (1) copy of the share certificate of each paid-up capital shareholder
- Two (2) most recent passport-sized colour photographs of each member of the Board of Directors and Paid-Up Capital Shareholders
PROVISION OF PREMISES - Premises (Area)
- At least 4,000 sf according to the following breakdown:
- Office space - 1,000 sf
■ Lecture room - 2,000 sf (4 rooms x 500 sf) ■ Library/AV room/other facilities - 1,000 sf - Ownership
- Not sharing with other businesses
LICENSE - The license shall only be issued when all requirements related to the Training Institution's premises and the licensing fee have been fulfilled/settled by the applicant.
- Business can only commence when the license has been issued to the applicant.
- Duration of license
TYPE OF COURSES CONDUCTED - Diploma and certificate level courses that are related to tourism and are skill oriented.
- The courses conducted need to be certified by the National Vocational Council.
- Short-term language courses (non-degree) that emphasise communication skills.
METHODS OF PAYMENT - All payments shall be made in the form of bank draft/money order/cashier's order in the name of the Commissioner of Tourism, Ministry of Tourism. The name of the company and the Ministry's file reference number (if any) shall be clearly written on the back of the bank draft/money order/cashier's order.
LOCATIONS FOR THE SUBMISSION OF APPLICATION FORMS - Licensing Division, Ministry of Tourism, Malaysia, Kuala Lumpur - Applications from the Federal Territory of Kuala Lumpur, Putrajaya, Selangor, Negeri Sembilan, sections of the districts of Pahang (the districts of Temerloh, Jerantut, Bera, Raub, Bentong, Kuala Lipis and Cameron Highlands) and parts of Perak (Ipoh, Tanjung Malim, Tapah, Teluk Intan, Lumut, Pulau Pangkor, Sitiawan and Batu Gajah)
- Northern Region Licensing Office - Applications from Kedah, Langkawi, Penang, Perlis and northern Perak which covers towns in northern Ipoh (the districts of Taiping, Grik, Lenggong, Sg Siput, Kampar, Kuala Kangsar and Krian)
- Eastern Region Licensing Office - Applications from Kelantan, Terengganu and parts of Pahang (Kuantan and the districts of Pekan and Maran)
- Southern Region Licensing Office - Applications from Johor, Malacca and parts of Pahang (the districts of Rompin and Pulau Tioman)
Sabah Regional Licensing Office - Applications from Sabah and the Federal Territory of Labuan - Sarawak Regional Licensing Office - Applications from Sarawak
