GUIDELINES FOR THE APPLICATION OF EXCURSION BUS AND HIRE AND DRIVE CAR LICENSES

EXCURSION BUS
  • “Excursion Bus” refers to a bus used exclusively for the conveyance of tourists and which incurs payment(s) that do not have prescribed fixed categories of fares.

HIRE AND DRIVE CAR

  • “Hire and drive car” refers to a motor vehicle hired out for the purpose of being driven by the hirer or his nominee, whether a tourist or non-tourist and used exclusively to convey a tourist or tourists.

WHO CAN APPLY?

  • The applicant must be a tourism company registered and licensed by the Tourism Ministry to operate an inbound tour operating business and which satisfies the licensing conditions stipulated by the Ministry of Tourism, Malaysia. The license must still be valid when submitting the application.

APPLICATION FORMS

  • Application shall be made by submitting one (1) copy of the application form according to the following types of application.
    • Form 1 (Sub regulation 3(1) ) - Application for new license/supplementary license for excursion bus
    • Form 2 (Sub regulation 3(1) ) - Application for new license/supplementary license for hire and drive car
    • Form 4 (Sub regulation 7(1) ) - Application for renewal of excursion bus license
    • Form 5 (Sub regulation 7(1)) - Application for renewal of hire and drive car license
    • Form 6 (Sub regulation 14(1)) - Application for a variation of the conditions of the excursion bus or hire and drive car licenses
    • Form 7 (Sub regulation 4(4) ) - Application for a variation of the conditions of the Conditional Letter of Approval for excursion bus or hire and drive car
  • The complete form together with the required supporting documents attached must be submitted directly to the Licensing Division, Ministry of Tourism, Malaysia, Kuala Lumpur or to the relevant Regional Licensing Offices.

DOCUMENTS THAT MUST BE ATTACHED

  • EXCURSION BUS
    • Companies Act 1965 forms verified by the Companies Commission of Malaysia (CCM) as follows:
      • One (1) copy of Form 24 - Return of Allotment of Shares
      • One (1) copy of Form 49 - Return Giving Particulars in Register of Directors, Managers and Change of Particulars
      • One (1) copy of Form 32A - Transfer of Securities
    • Copies of company’s bank statements for the last three (3) months
    • Copy of the latest audited annual financial statement
    • Examples of tour packages offered as well as brochures
    • Copy of appointment letter as ‘Ground Handler’ from overseas company(s) (if any)
    • List of names and statistics of tourists handled in the last three (3) months according to type of package
    • Copies of invoices and receipts of payments for rental of excursion bus from other companies for the last three (3) months
    • Letter of confirmation and address of bus storage depot owned by the company or approved by the local authority
    • Copies of documents to prove the financial capacity of the company to finance the purchase of the bus such as overdrafts, bank guarantees and bank loans
    • List and copy of existing excursion bus license if applying for supplementary license
  • HIRE AND DRIVE CAR
    • Companies Act 1965 form verified by the Companies Commission of Malaysia (CCM) as follows:
      • One (1) copy of Form 24 - Return of Allotment of Shares
      • One (1) copy of Form 49 - Return Giving Particulars in Register of Directors, Managers and Change of Particulars
      • One (1) copy of Form 32A - Transfer of Securities
    • Copies of company’s bank statements for the last three (3) months
    • Copy of the latest audited annual financial statement
    • Examples of tour packages offered as well as the brochures printed
    • Copy of the latest contract/letter of agreement received from institutions/corporate bodies which require the services of the Hire and Drive Car Company
    • Copies of documents to prove the rental/use of existing hire and drive car for the last three (3) months
    • Letter of confirmation and address of hire and drive car storage depot owned by the company or approved by the local authority
    • Copies of documents to prove the company’s financial capacity to finance the purchase of the hire and drive car such as overdrafts, bank guarantees and bank loans
    • List and copy of existing hire and drive license if applying for supplementary license

PROCESSING FEES

  • The processing fees according to the types of application are as follows:
    • Application for new license/supplementary license for excursion bus or hire and drive car - RM50.00 per application
    • Application for renewal of excursion bus or hire and drive car license - RM20.00 per application
    • Application for a variation of the conditions of the excursion bus or hire and drive car license - RM10.00 per license
    • Application for a variation of the conditions of the Conditional Letter of Approval for excursion bus or hire and drive car - RM10.00 per conditional letter of approval
  • All payments shall be made in the form of bank draft/money order/postal order in the name of the Pesuruhjaya Pelancongan.

DURATION OF LICENSE

  • The tourism vehicle license (excursion bus and hire and drive car) shall be valid for a period not exceeding three (3) years, subject to the age limit of the vehicle as prescribed by the Commissioner of Tourism.

AGE LIMIT OF TOURISM VEHICLE

  • The age limit of an excursion bus is set at 7 years, commencing from the year of manufacture and may be extended to a maximum of 12 years subject to technical certification by PUSPAKOM and physical inspection by officials of the Licensing Division, Ministry of Tourism. For a hire and drive car with a 1800 cc horsepower and below, the prescribed age limit is 5 years. The age limit for a luxury car with a horsepower of 2000 cc and above is 7 years.

STANDARD COLORS AND SIGNS ON BUS BODY

  • According to Regulations 15 and 16 of the Tourism Vehicle Licensing Act 1999, the standard colours and signs on excursion buses came into effect on 1 January 2001.
  • STANDARD COLORS FOR EXCURSION BUS - Regulation 15(1) - The standard colors for an excursion bus shall be as follows:
    • 1/3 of the outer sides of the left, right and back of the bus shall be painted conifer green. This 1/3 shall be measured from the section below the window until the lowest part of the body of the bus.
      • Conifer Green Colour Code:
        • Nippon: 041
        • ICI: 13041
    • 2/3 of the outer parts of the bus body shall be painted white. It is encouraged that this section be decorated with attractive colours, patterns or motifs according to the creativity of the respective company, reflecting a suitable image of Malaysia.
      • White Colour Code
        • Nippon: A 008
        • ICI: 15008

SIGNS ON BODY OF EXCURSION BUS

  • Regulation 16(1) - The signs on an excursion bus shall be as follows:
    • The words “BAS PERSIARAN” shall be affixed on the left and right hand sides of the bus using a thick black Arial font with slanted letters in accordance with the measurements as below:
      • 30 cm from the back of the bus
      • 30 cm from below the window
      • The height of each letter is 205 mm
      • The width of each letter is 40 mm
    • On the outer left, right and behind the front tyre within the conifer green color parts of the bus, the following details shall be affixed:
      • Name, current address and telephone number of license holder
      • Reference number of license issued by the Commissioner
      • Reference number of the tourism vehicle license
      • Seating capacity
      • Each letter measuring 25 mm in height and printed black
    • The speed limit and weight of the bus shall be affixed at the back of the bus.


EXCURSION BUS/HIRE AND DRIVE CAR

APPLICATION FOR EXCURSION BUS LICENSE: EVALUATION CRITERIA

  • The company shall be registered/licensed by the Ministry of Tourism, Malaysia to operate an inbound tour operating business.
  • The company shall satisfy the licensing conditions stipulated by the Ministry of Tourism, Malaysia as set forth below:
    • Has adequate paid-up capital as follows:
      • For companies in major towns (Kuala Lumpur, Ipoh, Johor Bahru, Penang, Kota Kinabalu and Kuching) RM200,000.00
      • For companies outside major towns:
        • Inbound Tour RM50,000.00
        • Inbound Tour and Travel Agency RM150,000.00
        • Inbound and Outbound Tour and Travel Agency RM200,000.00
    • Has the financial ability to finance the purchase of the excursion bus such as overdrafts, fixed deposits, bank guarantees and bank loans
    • Has proofs of tour package operations that require the use of excursion bus such as:
      • List of names and statistics of tourists handled
      • Receipt/invoice of the hiring of excursion bus from another company
      • Receipt/invoice of tourist accommodation
    • Has suitable bus storage depot
    • To add to the existing number of licenses, the company shall submit:
      • List and copies of existing excursion bus licenses
      • The performance of the inbound tours handled
      • The itinerary of existing excursion buses

EXCURSION BUS/HIRE AND DRIVE CAR

APPLICATION FOR HIRE AND DRIVE CAR LICENSE: EVALUATION CRITERIA

  • The company shall be registered/licensed by the Ministry of Tourism, Malaysia to operate an inbound tour operating business.
  • The company shall satisfy the licensing conditions stipulated by the Ministry of Tourism, Malaysia as set forth below:
    • Has adequate paid-up capital as follows:
      • For companies in major towns (Kuala Lumpur, Ipoh, Johor Bahru, Penang, Kota Kinabalu and Kuching) RM200,000.00
      • For companies outside major towns:
      • Inbound Tour RM50,000.00
      • Inbound Tour and Travel Agency RM150,000.00
      • Inbound and Outbound Tour and Travel Agency RM200,000.00
    • Has a suitable location for its operation
    • Has contract with any institution/corporate body which requires the services of the hire and drive car company
    • Holds franchise for hire and drive car (if any)
    • Has suitable car storage depot
    • Has the financial ability to finance the purchase of the vehicles such as overdrafts, fixed deposits, bank guarantees and bank loans
    • To add to the existing number of licenses, the company shall submit:
      • List and copies of existing hire and drive car licenses
      • The performance of the inbound tours handled
      • Proofs of the hiring/use of existing hire and drive cars

EXCURSION BUS/HIRE AND DRIVE CAR

APPLICATION FOR BUS EXCURSION LICENSES FROM FOREIGN OPERATORS WHO WISH TO ENTER MALAYSIA: EVALUATION CRITERIA

  • The company shall be registered and licensed as a tour agency by its country, for instance the Singapore Tourism Board (STB) in the case of Singapore and the Thailand Tourism Board (TTB) in the case of Thailand, similarly with Brunei.
  • Has a paid-up capital exceeding RM200,000.00.
  • Has the financial ability to finance the purchase of the excursion bus such as overdrafts, fixed deposits, bank guarantees and bank loans
  • Has proofs of tour packages to Malaysia such as:
    • List of names and statistics of tourists handled
    • Copy of receipt/invoice of the hiring of excursion bus from another company
    • Copy of receipt/invoice of tourist accommodation in Malaysia
    • Copy of payment invoice for the services of Malaysian Tourist Guides who are licensed by this Ministry
  • The tourists carried shall spend at least 2 nights in any hotel in Malaysia.
  • The excursion bus shall be insured including passenger liability.
  • The excursion bus is only allowed to be in Malaysia for not more than seven (7) days.
  • While travelling in this country, each excursion bus shall carry a list containing the names of the tourists as well as their passport numbers and full addresses.
  • Each bus that enters this country must be at least 50% occupied by passengers/tourists out of the total number of seats in the bus.
